Inadequate Security Resulting In Criminal Assault

JFS Law Firm handles claims for inadequate security based on property owners’ failure to provide adequate security measures to protect against criminal assaults or murder.

In Florida, a property owner or occupant who invites others to enter for some purpose of interest or advantage to the owner or occupant, or who by acts of conduct is induced to believe that the public has a right to enter thereon, must use reasonable care to have the premises in reasonably safe condition.

In Florida, an owner or occupier of a premise has two basic duties to someone invited (ie. customer, guest, or visitor) on to the property:

(1) to use ordinary or reasonable care in keeping the premises in a reasonably safe condition; and
(2) to warn of latent or concealed perils that are known or should be known to the owner or occupant, of which the invitee is unaware and the invitee cannot discover through the exercise of reasonable care. An owner or occupant of premises owes a duty to use reasonable care to learn of any dangerous or hazardous conditions, and to take reasonable care to eliminate known dangers, protect invitees from the dangers by excluding them from the area, or provide warnings of the danger.

  • Slippery floor or tile

  • No railings or broken railings
  • Poor lighting
  • Uneven pavement or broken sidewalks
